Exporting private-label agro products to India, USA, or EU requires navigating three distinct labelling and food safety frameworks: FSSAI (India), FDA (USA), and EU Regulation 1169/2011 (Europe). Each has different nutrient disclosure, allergen protocols, and package insert requirements. This guide clarifies requirements, common violations, and compliance checklists for each region.

Three Regimes, Three Compliance Nightmares Waiting to Happen

If you're exporting private-label food products (rice, spices, coffee, dried fruits, prepared meals) internationally, you will encounter three regulatory frameworks — often simultaneously if you're shipping to multiple regions. The frameworks are not compatible: what's compliant in India is often non-compliant in the USA, and vice versa. This guide maps the three frameworks, highlights common violations that trigger port holds and recalls, and provides checklists for each region.

FSSAI (Food Safety and Standards Authority of India) — For India & South Asia

Scope: Mandatory for all packaged food products sold in India and SAARC countries (Bangladesh, Pakistan, Sri Lanka, Nepal).

Key Requirements:
1. License Type: FSSAI registration (₹100–₹1,000 one-time, online) for businesses <20 employees; FSSAI license (₹1,000–₹5,000 renewable annually) for larger operations. Private-label resellers typically need registration or license depending on your facility type.

2. Nutrition Facts Label (NFM): FSSAI mandates nutrition per 100g format:
• Energy (kcal/kJ)
• Protein (g)
• Total Fat (g) — with breakdown of saturated fat if declared
• Carbohydrate (g)
• Added sugar (g) if applicable
• Sodium (mg)
• Iron (mg) if fortified
• Calcium (mg) if fortified

Rounding rules: Energy ±10%, all others ±10%.

3. Allergen Declaration: Mandatory if product contains any of: milk, eggs, peanuts, tree nuts, sesame, mustard, celery. Label must read: 'Contains: [allergen]' on principal display panel or separate allergen box.

4. Lot/Batch Number & Date: Mandatory. Format: 'Mfg Date: DD/MM/YYYY' and 'Best Before: DD/MM/YYYY' OR 'Use By'. For dry goods (rice, spices), best-before can be 2–3 years from manufacture.

5. Language: Hindi + English mandatory. Regional languages (Tamil, Telugu, Marathi, etc.) recommended for that region but not mandatory at national level.

6. Facility Details: Name + address of food business operator (FBO) on label.

Common FSSAI Violations: Missing nutrition facts (most common), incorrect lot numbering, missing allergen declaration, misleading health claims ('Cures diabetes' — prohibited), undeclared allergens. Penalty: Product seizure, ₹1 lakh–₹10 lakh fine, jail term up to 6 months for serious violations.

FDA (Food and Drug Administration) — For USA Exports

Scope: Mandatory for all food products imported into the USA. FDA pre-approval registration required (Form FDA 2541a, online, free). Current Good Manufacturing Practices (CGMP) compliance verification required.

Key Requirements:
1. FDA Registration: Every facility manufacturing or processing food for US export must be FDA-registered and re-registered biennially (January of even years). Cost: free. Required: facility name, address, facility type (manufacturer, packer, distributor).

2. Nutrition Facts Label (NFM): FDA format (different from FSSAI):
• Serving size (in metric units: grams, mL) — FDA specifies serving sizes for food categories (rice: 45g per serving, coffee: 5g per serving)
• Servings per container
• Calories per serving
• % Daily Value basis (13 core nutrients): Total fat, saturated fat, trans fat, cholesterol, sodium, carbs, fiber, sugar, protein, vitamin D, calcium, iron, potassium
• Ingredient list (decreasing weight order)

Mandatory declaration if ≥0.5g: Added sugars. Optional but recommended: saturated fat, fiber, potassium.

3. Allergen Declaration: FDA 'Big 9' mandatory: milk, eggs, fish, crustacean shellfish, tree nuts, peanuts, wheat, soybeans, sesame. Format: 'Contains: [allergen]' on principal display or separate box. If product is manufactured in a facility that also processes allergens, label must state: 'May contain [allergen]' (precautionary).

4. Ingredient List: Mandatory. All ingredients by weight order. FDA-approved names (not brand names). Subcomponents must be declared if they contain allergens ('Contains: wheat' if an ingredient contains wheat).

5. Net Weight: In both metric (g, mL) and imperial (oz, lb) units. Metric first, then parenthetical imperial.

6. Manufacturer/Distributor Line: 'Manufactured/Distributed by: [Name], [Address], [City, State, ZIP]'. If you're the distributor (not manufacturer), label must clarify: 'Distributed by' instead of 'Manufactured by'.

7. Country of Origin: Not required on label but required on Customs entry documents ('Product of India').

Common FDA Violations: Serving size inconsistencies, missing allergen declaration (highest compliance concern), incorrect nutrition facts rounding, undeclared subcomponent allergens, missing facility registration. Penalty: Detention at port of entry (up to 90 days), product seizure, $10,000+ fine per violation, possible recall.

EU Regulation 1169/2011 — For EU/UK Exports

Scope: Mandatory for all packaged food products sold in EU27 + UK (post-Brexit, separate UK labelling required for UK-only shipments). No pre-approval registration, but product liability insurance required (€5M–€10M typical).

Key Requirements:
1. Nutrition Facts Label (NFM): EU format (per 100g mandatory; per serving optional):
• Energy (kJ + kcal)
• Fat (g): with breakdown for saturated fat, trans fat
• Carbohydrate (g): with breakdown for sugars, starch
• Protein (g)
• Salt (g) — NOT sodium (key difference from FDA)
• Optional but recommended: fiber, vitamins/minerals if declared or fortified

Rounding: Energy ±5%, all others ±5%.

2. Allergen Declaration: EU '14 allergens' mandatory: milk, eggs, fish, crustaceans, molluscs, tree nuts, peanuts, celery, mustard, sesame, sulfites, lupin, molluscs, cereals (wheat, rye, barley, oats). Format: Bold or highlight allergen name in ingredient list. Separate allergen statement: 'Contains: [allergen]' optional but recommended for clarity.

3. Language: Language of the country where product is sold. English acceptable in UK. French mandatory for France-destined products. German for Germany, etc. Multilingual packaging: all 27 EU languages on single label is impractical — common solution: one label per language variant.

4. Name & Address of Food Business Operator: Mandatory. Importer's name + address if product is imported (different from manufacturer).

5. Origin Labeling: Mandatory if origin absence would mislead consumer. For agro products (rice, coffee, spices), if product says 'Indian Arabica' or 'Premium Basmati', origin must match. If generic ('Spices Mix'), origin not required.

6. Nutrition Claims & Health Claims: Strictly regulated. Claims must be substantiated. Prohibited claims: 'Cures cancer', 'Improves immunity' (unsubstantiated). Allowed claims: 'Source of fibre', 'Contains [nutrient]', 'Reduced fat' (if <50% of reference food).

7. GMO Labelling: If product contains >0.9% GMO content, label must state: 'Genetically modified' or 'Contains genetically modified ingredients'. For agro commodities (rice, spices), GMO content verification required if non-GMO is claimed.

Common EU Violations: Allergen highlight failure (most common), nutrient rounding errors, health claim substantiation, incorrect language, insufficient font size (mandatory: 1.2 mm minimum for most text, 0.9 mm for net quantity). Penalty: Product detention at port, product recall, €5,000–€100,000 fine depending on member state, possible market ban.

Cross-Region Labelling Strategy for Multi-Market Export

Option 1: Region-Specific Labels (Recommended for Premium Brands) — Create separate label designs for FSSAI, FDA, and EU compliance. Cost: 3x label design time, but ensures 100% compliance for each market. Best for: high-volume exports, established brands targeting specific regions sequentially.

Option 2: Universal Compliant Label — Design a single label that satisfies all three frameworks simultaneously. Requires: nutrition facts in both formats (per 100g + per serving), all allergens from all 3 lists (29 total unique allergens), multilingual layout (English + Hindi + EU languages). Cost: 1x design, but label becomes cluttered. Best for: volume-commodity exporters who want single-label economy of scale.

Implementation Path: Phase 1 (India): FSSAI-compliant label, launch domestic PL. Phase 2 (USA): Add FDA compliance, export to North America (4–6 weeks for FDA registration + label approval). Phase 3 (EU): Add EU compliance, export to Europe (6–8 weeks for notification + label approval).
